Who owns the airspace above land and water

This section says that the owner of the land or water surface also owns the space above it. But that ownership is limited by the right of aircraft to fly over, as described in another section.

The ownership of the space above the lands and waters of the State is declared to be vested in the several owners of the surface beneath, subject to the right of flight described in section 263-4.
