Liability to non-passengers and non-shippers

This section lets people who are not passengers or shippers sue the state for property damage, injury, or death caused by state ferries or terminals. But any money you win cannot be more than the state's insurance coverage for that kind of claim.

The statute, as written — Liability to persons other than shippers or passengers; limitation

The right of action extended by this chapter shall be applicable to loss or damage of property or personal injury or death, resulting from the operation of ferries or terminals by the department of transportation to persons other than shippers or passengers, but any recovery of damages in such cases shall not exceed an amount equal to the limitations of the insurance carried by the department to insure it against loss for such liability.
