Changing your mind about a request

A qualified patient can cancel their request anytime, in any way, no matter their mental state. The doctor cannot give the prescription unless they offered the patient a chance to cancel during the second oral request.

The statute, as written — Right to rescind request

A qualified patient may rescind the request at any time and in any manner without regard to the qualified patient's mental state. No prescription under this chapter shall be made available pursuant to section 327L-4(a)(12) if the attending provider has not offered the qualified patient an opportunity to rescind the request at the time of the second oral request made pursuant to section 327L-9.
