Ban on making or selling products with certain flame retardants

Starting January 1, 2006, no one may make, process, or sell in commerce any product or flame-retarded part that contains more than 0.1% by mass of pentaBDE, octaBDE, or similar chemicals. This is a ban on certain flame retardants.

The statute, as written — Restriction on manufacture or distribution

On or after January 1, 2006, a person may not manufacture, process, or distribute in commerce a product, or a flame-retarded part of a product, containing more than one-tenth of one per cent, by mass, of pentaBDE, octaBDE, or any other chemical formulation that is part of these classifications.
