Court orders and fines for breaking water pollution rules

If you break the water pollution rules in this chapter, the board can take you to court. The court can order you to stop the violation and make you pay a daily fine. The fine is at least $100 and at most $200 for each day the violation continues.

The statute, as written — Injunctions and civil penalty

Any person who violates any provision of this chapter, or any rules, regulations, criterion, procedure, or certificate issued hereunder may, in a legal action commenced by the board: (1) Be enjoined from continuing such violation; and (2) Be subject to a civil penalty of not less than $100 a day and not greater than $200 a day for each day of continuing violation.
