How this law affects other local rules

This section says that any state or county law or rule that conflicts with this chapter is invalid. However, counties can still make their own rules about underground storage tanks, as long as those rules do not conflict with the state department's rules. If a county rule conflicts with a state rule, the county rule is void.

The statute, as written — Effect of laws, ordinances, and rules

(a) All laws, ordinances, and rules inconsistent with this chapter shall be void and of no effect. (b) Any county may adopt ordinances and rules governing any matter relating to underground storage tanks or tank systems that are governed by a rule of the department adopted pursuant to this chapter; provided that any county ordinance or rule relating to underground storage tanks or tank systems shall be void and of no effect if inconsistent with a rule of the department upon the adoption thereof.
