State rules for underground storage tanks and hearing officers

The state director can make, change, or remove rules about underground storage tanks and tank systems. These rules must follow the state's rulemaking process. The director can also hire hearing officers to run public meetings and hearings, without following normal hiring rules.

(a) The director may adopt, amend, and repeal state rules controlling and regulating underground storage tanks and tank systems. All rules shall be adopted pursuant to chapter 91. (b) In addition to other specific powers provided in this chapter, the director may appoint without regard to chapter 76, hearings officers to conduct public participation activities including public hearings and public informational meetings.
