Fines for breaking these rules and how they are enforced

This section sets fines for anyone who breaks the rules in this part. The fine is up to $1,000 per day, but can be up to $3,000 per day for certain specific violations. The department can enforce the rules through administrative or court proceedings, or both.

The statute, as written — Penalty; remedies

(a) Any person, entity, agency, or organization violating any provision of this part or any rule made pursuant thereto shall be fined up to $1,000 for each day of violation; provided that the fine may be up to $3,000 for each day for a violation of section 346-161 or 346-171. (b) The department may enforce this part in either administrative proceedings or judicial proceedings, or both.
