HRS §386-172

Who runs the injury claim process and how it works

This section says the labor director is in charge of handling claims under section 386-171. The process, including appeals, follows the same rules as other claims in this chapter. Injured workers must tell their department head, who then reports to the director. The director can make rules to run the program.

The statute, as written — Administration and procedure

Section 386-171 shall be administered by the director of labor and industrial relations. Procedure in respect of claims hereunder, including procedure upon appeals, shall correspond to the procedure provided under this chapter. Notice of injury shall be given to the head of the department for which the injured person is performing service, and the department head shall report the injury to the director. The director may make such rules and regulations as the director may deem necessary or convenient for carrying out section 386-171.
