What happens to an appeal when a reconsideration is issued

If you have an appeal waiting for a decision and the agency reconsiders its original decision, your appeal is automatically treated as an appeal of the new reconsidered decision, unless you withdraw it.

The statute, as written — Appeal pending when reconsideration issued

In the event that an appeal is pending as of the date a reconsideration thereof is issued, the appeal, unless withdrawn, shall be treated as an appeal from the reconsideration.
