Insurance company must give claim forms when asked
If you say you have a loss under an insurance policy and ask in writing, the insurance company must give you the claim forms to fill out. But the company is not responsible for how you fill them out or whether you complete them correctly.
The statute, as written — Forms for proof of loss furnished
Upon written request of any person claiming to have a loss under any insurance contract, an insurer shall furnish forms of proof of loss for completion by the person. The insurer shall not, by reason of the requirement to furnish forms, have any responsibility for or with reference to the completion of the proof of loss form or the manner of completion or attempted completion.
