Order of certain policy provisions

This section says how insurance companies must arrange certain required policy provisions. They can print them in the order listed in the law, or group related ones together, as long as the whole policy is clear and not confusing or misleading.

The statute, as written — Order of certain policy provisions

The provisions which are the subject of section 431:10A-105 and section 431:10A-106, or any corresponding provisions which are used in lieu thereof, shall be printed in the consecutive order of the provisions in such sections or, at the option of the insurer, any such provision may appear as a unit in any part of the policy, with other provisions to which it may be logically related; provided the resulting policy shall not be in whole or in part unintelligible, uncertain, ambiguous, abstruse, or likely to mislead a person to whom the policy is offered, delivered or issued.
