HRS §431:10A-111

Policy terms cannot be worse than required ones

This section says that any part of an insurance policy not already covered by other rules cannot make the policy worse for the insured or beneficiary than the parts that are covered by those rules. It protects you from unfair terms.

No policy provision which is not subject to section 431:10A-105 or section 431:10A-106 shall make a policy, or any portion of the policy, less favorable in any respect to the insured or the beneficiary than the provisions which are subject to this part.
