How car insurance rates are checked and refunds ordered

The insurance commissioner must review car insurance rates using the rules in article 14, unless another part of this law says otherwise. If an insurance company makes too much profit, the commissioner must order the company to give the extra money back to policyholders.

The statute, as written — Rate administration

(a) Except as otherwise provided in this article, the commissioner shall implement and evaluate motor vehicle insurance rates in compliance with article 14. (b) The commissioner shall order insurers to rebate to policyholders any excessive profit realized by insurers from their operations.
