Total loss motor vehicle claims

When your car insurance policy says it will pay for a total loss based on actual cash value or replacement, the insurance company must use one of two methods: replacing the car or paying you cash. The details of each method are in separate sections.

When a motor vehicle insurance policy provides for the adjustment and settlement of an insured's motor vehicle's total losses on the basis of actual cash value or replacement, the insurer shall follow either the replacement method set forth in section 431:10C-310 or the cash settlement method set forth in section 431:10C-311.
