Freezing insurer assets during liquidation is banned

While an insurance company is being liquidated in Hawaii or another state, no one can start or continue a court action to seize the company's money or property in Hawaii. This rule protects the insurer's assets during the liquidation process.

The statute, as written — Attachment, garnishment and levy of execution

During the pendency in this or any other state of a liquidation proceeding, whether called by that name or not, no action or proceeding in the nature of an attachment, garnishment or levy of execution shall be commenced or maintained in this State against the delinquent insurer or its assets.
