HRS §431:4-212

When arbitrage rules do not apply

This section says that certain arbitrage transactions are not covered by the rules in sections 431:4-208 to 431:4-210, unless the insurance commissioner has adopted rules that say otherwise. The commissioner can make rules to carry out the purposes of the broader arbitrage sections.

The statute, as written — Arbitrage transactions not affected

Section 431:4-208 to section 431:4-210 shall not apply to foreign or domestic arbitrage transactions unless made in contravention of such rules and regulations as the commissioner may adopt in order to carry out the purposes of section 431:4-208 to section 431:4-214.
