HRS §431:4-308
Who is a member of a mutual insurance company
This section says that anyone who has an insurance policy from a Hawaii-based mutual insurance company (except a reinsurance contract) is automatically a member of that company. The policy itself must state this membership. Members have the rights and duties that come with membership.
The statute, as written — Membership
Each holder of one or more insurance contracts issued by a domestic mutual insurer, other than a contract of reinsurance, is a member of the insurer, with the rights and obligations of such membership, and each insurance contract issued shall so stipulate.
