Mutual benefit societies can get a charter

A mutual benefit society can become a corporation by getting a charter, even if the general corporation law would not allow it for that purpose. Once chartered, the society must follow all the rules in this article.

The statute, as written — Incorporation by charter

Any mutual benefit society may be or become incorporated by charter, notwithstanding any limitations under the corporation law as to the purposes for which charters may be granted. Any society so chartered as a corporation shall be subject in all respects to this article.
