HRS §432G-18
Exemption for dental insurers in federal programs
This section says that dental insurers offering dental insurance through a federally funded program under the Social Security Act do not have to follow the state's rules about required coverages or essential health benefits. The exemption only applies to the part of their business that is under that federal program.
The statute, as written — Federally funded programs; exemption
Requirements provided in this chapter relating to mandated coverages or essential health benefits shall not be applicable to any dental insurer offering dental insurance under a federally funded program under the Social Security Act, as amended; provided that this exemption shall apply only to that part of the dental insurer's business under the federally funded program.
