HRS §436B-22

Giving up a license does not stop investigations

If you give up, surrender, or do not renew your license, the licensing authority can still investigate you and take action against your license, such as revoking, suspending, or fining you. This section makes clear that giving up your license does not end their power.

The statute, as written — Relinquishment no bar to jurisdiction

The forfeiture, nonrenewal, surrender, or voluntary relinquishment of a license by a licensee shall not bar jurisdiction by the licensing authority to proceed with any investigation, action, or proceeding to revoke, suspend, condition, or limit the licensee's license or fine the licensee.
