HRS §437D-16

When state insurance rules do not apply to collision coverage

This section says that the rules in this chapter do not apply to collision insurance sold by an insurance company that is allowed to do property and casualty business in Hawaii. But this only works if the insurance company is not a car rental company or a limited line rental car insurance seller.

The statute, as written — Application of insurance laws

None of the provisions of this chapter shall apply to the issuance of collision insurance underwritten by an insurer authorized to transact property and casualty business in this State; provided that the insurer is not a lessor as defined in this chapter or a limited line motor vehicle rental company producer as defined in [section] 431:9A-141.
