Who pays for a lawsuit on the bond

If someone other than the treasurer sues on the bond, that person must file the lawsuit in their own name and pay all the costs, charges, and expenses themselves. The treasurer is not responsible for those costs.

In case action on the bond is brought by any person other than the treasurer, the action shall be in the name and at the sole cost, charge, and expense of the plaintiff.
