Prohibited acts

This section says you cannot practice mental health counseling or call yourself a licensed mental health counselor without a valid license. Breaking this rule can lead to a fine, and each day you break it counts as a separate violation. The fine is collected through a civil action.

The statute, as written — Prohibited acts

[Section effective until June 30, 2026. For section effective July 1, 2026, see below.] Except as specifically provided in this chapter, no person shall engage in the practice of mental health counseling or use the title of "licensed mental health counselor" or "mental health counselor" without a valid license issued under this chapter. Any person who violates this section shall be subject to a fine of not more than $1,000 for each separate offense. Each day of each violation shall constitute a separate offense. Any action taken to impose or collect the fine imposed under this section shall be a civil action.
