Violation; remedies

If a health club breaks this chapter's rules, that is an unfair or deceptive act. A buyer harmed by the violation can sue for damages. A contract that does not follow the rules cannot be enforced against the buyer.

The statute, as written — Violation; remedies

(a) A violation or failure to comply with any of the requirements of this chapter shall constitute an unfair or deceptive act within the meaning of section 480-2. (b) Any buyer damaged as a result of a violation or failure to comply with any of the requirements of this chapter may bring an action for recovery of damages. (c) Any health club contract that fails to comply with the requirements of this chapter shall be unenforceable against the buyer.
