When this law applies to home sales

This law applies to most sales of homes and other residential property in Hawaii, unless another part of the law says it does not. If a seller or their agent does not follow this law, the sale is still valid and the buyer's ownership is not affected.

The statute, as written — Applicability

Except as otherwise provided for in this chapter, this chapter applies to any sale of residential real property. The failure of the seller or the seller's agent to comply with this chapter shall not affect the validity of title to any residential real property sold.
