Trustee protection for following the trust document

A trustee who reasonably follows what the trust document says is not responsible to a beneficiary for any mistake that came from following it. This protects trustees who act in good faith based on the written trust terms.

The statute, as written — Reliance on trust instrument

A trustee who acts in reasonable reliance on the terms of the trust as expressed in the trust instrument shall not be liable to a beneficiary for a breach of trust to the extent the breach resulted from the reliance.
