Trustee's duty to enforce and defend trust claims

A trustee must take reasonable steps to pursue claims the trust has and to defend against claims made against the trust. The trustee can give up or hand over a claim to beneficiaries if it thinks pursuing it isn't wise.

The statute, as written — Enforcement and defense of claims

(a) A trustee shall take reasonable steps to enforce claims of the trust and to defend claims against the trust. (b) A trustee may abandon or assign to one or more of the beneficiaries of the trust any claim that it believes is not prudent to enforce.
