Physical or mental examination and treatment

This section lets a family court order a child in a case to be examined or treated by a doctor or mental health professional, possibly in a hospital. It can also order a parent or guardian to be examined if their ability to care for the child is questioned, but only after a hearing.

The statute, as written — Physical or mental examination and treatment

The court may order that a child or minor for whom a petition has been filed, be examined by a physician, surgeon, psychiatrist, or psychologist. The court may order treatment by a physician, surgeon, psychiatrist, or psychologist of a child or minor who has been adjudicated by the court. For either the examination or treatment, the court may place the child or minor in a hospital or other suitable facility. After a hearing, the court may order an examination by a physician, surgeon, psychiatrist, or psychologist of a parent or guardian whose ability to care for a child before the court is at issue.
