Enforcing part of a foreign support order

When a Hawaii court cannot enforce a foreign child support order completely, it must still enforce any part that can be separated. A person can ask the court to recognize and enforce only part of the order.

The statute, as written — Partial enforcement

If a tribunal of this State does not recognize and enforce a Convention support order in its entirety, it shall enforce any severable part of the order. An application or direct request may seek recognition and partial enforcement of a Convention support order.
