Appealing a child custody order

This section explains how to appeal a final decision in a child custody case. It says you can appeal using the same fast process as other civil cases. The court cannot pause the custody order while the appeal is happening, unless there is a temporary emergency order.

The statute, as written — Appeals

An appeal may be taken from a final order in a proceeding under this part in accordance with expedited appellate procedures in other civil cases. Unless the court enters a temporary emergency order under section 583A-204, the enforcing court shall not stay an order enforcing a child-custody determination pending appeal.
