Withdrawing consent to assisted reproduction before transfer

A person who agreed to assisted reproduction can change their mind and withdraw consent before the embryo transfer. They must tell the person giving birth and the clinic or doctor in writing. If they withdraw, they are not the child's parent under this law.

The statute, as written — Withdrawal of consent

(a) An individual who consents under section 584A-804 to assisted reproduction may withdraw consent any time before a transfer by giving notice in a record of the withdrawal of consent to the individual who agreed to give birth to a child conceived by assisted reproduction and to any fertility clinic or health care provider facilitating the assisted reproduction. Failure to give notice to the fertility clinic or health care provider shall not affect a determination of parentage under this part. (b) An individual who withdraws consent under subsection (a) is not a parent of the child under this part.
