When you can file a discovery lawsuit

This section allows a person to file a special court case to get information from another party, following old equity court rules. But if court rules already cover the situation, you cannot use this type of lawsuit. It is a narrow procedural rule.

A civil action in the nature of a bill for discovery may be brought according to the usages and principles of courts of equity, unless the matter is governed by the rules of court.
