HRS §624-45

Who pays the costs in these proceedings

This section says the person who asks for the proceeding or files the lawsuit must pay all its costs. However, those costs might later be counted as allowed expenses, similar to how deposition costs are handled.

The statute, as written — Costs

The applicant or plaintiff shall pay all costs of all proceedings under section 624-41, but such disbursements ultimately may be allowed in taxation of costs as in the case of disbursements for depositions.
