How to get a jury trial from small claims court

If you are in a small claims case and you have the right to a jury trial, you can ask for one. When you do, the case moves to the circuit court, where it will be tried with a jury. This section only covers that transfer process.

The statute, as written — Jury trial; demand; assignment to other court

In a case filed or pending in the small claims division of the district court in which a party entitled to a trial by jury files a demand therefor, the case shall be assigned to and tried in the circuit court under the procedure provided for jury trials.
