Case dismissed if required security is not posted

If a court orders someone to post security in a lawsuit and they do not do it, the case is dismissed permanently against the defendant who was supposed to be protected. This means the plaintiff cannot bring that claim again.

The statute, as written — Dismissal on failure to post security

When security that has been ordered is not furnished, the litigation shall be dismissed with prejudice as to the defendant for whose benefit it was ordered.
