HRS §658H-8
When mediation talks stay private
This section says that mediation communications are private unless the parties agree otherwise or another law or rule requires them to be shared. It also allows disclosure if required by Hawaii's open records laws.
The statute, as written — Confidentiality
Unless subject to disclosure pursuant to part I of chapter 92 or chapter 92F, mediation communications are confidential to the extent agreed by the mediation parties or provided by other law or rule of this State.
