Which laws apply to family arbitration

This section says that arbitration in family law cases follows the state's general arbitration rules, unless this chapter says otherwise. When deciding the case, the arbitrator must use Hawaii law, including its rules for choosing which state's law applies.

The statute, as written — Applicable law

(a) Except as otherwise provided in this chapter, the law applicable to arbitration is chapter 658A. (b) In determining the merits of a family law dispute, an arbitrator shall apply the law of this State, including its choice of law rules.
