HRS §662-10

Final court decision blocks later lawsuits

If you sue the state and get a final judgment, you cannot sue the state employee again for the same incident. This section makes that judgment a complete barrier to any later claim against that employee.

The statute, as written — Judgment as bar

The judgment in an action under this chapter shall constitute a complete bar to any action by the claimant, by reason of the same subject matter, against the employee of the State whose act or omission gave rise to the claim.
