How the crime of asking someone to commit a crime is graded

This section sets the punishment level for criminal solicitation. Generally, the crime is one level lower than the crime that was solicited. But soliciting murder is always a class A felony.

The statute, as written — Grading of criminal solicitation

Criminal solicitation is an offense one class or grade, as the case may be, less than the offense solicited; provided that criminal solicitation to commit murder in any degree is a class A felony.
