Appealing a denial or cancellation

If the department denies your application or cancels your certification, you can appeal in writing within 30 days of getting the notice. The appeal is not a formal court case, there is no hearing, and the department's final decision cannot be challenged in court.

Within thirty days of the date of the notice of denial of an application or of certification cancellation, an applicant or program participant may submit a written appeal to the department; provided that: (1) The appeal shall not be treated as a contested case as defined in chapter 91; (2) The appeal process shall not include a hearing; and (3) The department's final determination shall not be subject to judicial review.
