Death benefit for service members on leave

If a service member dies, the law treats them as being on approved unpaid leave. This makes their family eligible for the ordinary death benefit under the listed sections.

The statute, as written — Ordinary death benefit

If any service member dies, the service member shall be deemed to be on authorized leave without pay for the purposes of the ordinary death benefit provided in sections 88-84, 88-286(b), and 88-338.
