HRS §92-11

When official actions can be canceled

If a government body takes a final action without following the open meeting rules in sections 92-3 and 92-7, that action might be canceled. To cancel it, someone must file a lawsuit within 90 days of the action. This section only explains when and how quickly you can challenge such an action.

The statute, as written — Voidability

Any final action taken in violation of sections 92-3 and 92-7 may be voidable upon proof of violation. A suit to void any final action shall be commenced within ninety days of the action.
