Pending lawsuits continue after a law is repealed

If a lawsuit or prosecution was already started before a county law is repealed, that case can still go forward. The repeal does not stop or cancel the case. This section only covers cases that were already pending when the law was repealed.

No suit or prosecution pending at the time of the repeal of any resolution or ordinance, for any offense committed, or for the recovery of any penalty or forfeiture incurred under the resolution or ordinance repealed, shall be affected by that repeal. 1-8 GENERAL PROVISIONS § 1-9
