HCC §1-9

If one part of the code is invalid, the rest still stands

Read the official text at hawaiicounty.gov ↗

This section says that the county council wants each part of the county code to work independently. If a court decides that one part is invalid or unconstitutional, the other parts stay in effect. This is a standard rule to keep the rest of the code valid.

The ordinance, as written (Hawaiʻi County) — Severability

A copy, taken August 21, 2026. The version published by Hawaiʻi County is the one that governs, and it may have changed since. Check it before relying on anything here.

It is declared to be the intention of the council that the sections, subsections, paragraphs, sentences, clauses, and words of this Code are severable. If any section, subsection, paragraph, sentence, clause, or word is declared unconstitutional, or otherwise invalid by the lawful judgment or decree of any court of competent jurisdiction, its unconstitutionality or invalidity shall not affect the validity of any of the remaining sections, subsections, paragraphs, sentences, clauses, and words of this Code, since the sections or parts of sections would have been enacted by the council without and irrespective of any unconstitutional or otherwise invalid section, subsection, paragraph, sentence, clause, or word being incorporated into this Code. 1-9
