(a) In the event that any permittee under this chapter fails to: (1) Comply with all the terms and conditions of the permit to the satisfaction of the director of public works; (2) Complete all of the work authorized under the permit within the time limit specified in the permit; (3) Comply with all special precautions enumerated in section 10-24 and with all the requirements of the director of public works pursuant to section 10-24; or (4) Proceed under section 10-15(b); within thirty days after a permittee has been served with written notice thereof, either by mail or personal service, the council may order the permittee to be prosecuted as a violator of the provisions of this chapter and may order the director of public works to proceed with the work specified in such notice. A statement of the cost of such work shall be transmitted to the council who shall cause the same to be paid. Such cost shall be charged to the permittee or owner or both of the premises involved. (b) The County may enforce payment of such cost in any manner provided by law, including proceedings under chapter 507, part II, Hawai‘i Revised Statutes. For the purposes of the operation of part II of chapter 507, Hawai‘i Revised Statutes, the permittee shall be deemed to come within the definition of “owner” as defined in said chapter; the County shall be deemed to come within the definition of “general contractor” as defined in that chapter and the execution of work specified in the notice shall be deemed a contract between the permittee and the County.
