How the director decides a variance request

The director must decide on a variance application within 60 days, either denying it or approving it with conditions. The conditions must relate to the variance, and the decision must include the facts behind it. If the director does not decide in time, the application is automatically denied, and the applicant must be told.

(a) The director shall, within sixty days after acceptance of a variance application, deny the application or approve it subject to conditions. (b) The conditions imposed by the director shall bear a reasonable relationship to the variance granted. All actions shall contain a statement of the factual findings supporting the decision. (c) If the director fails to act within the prescribed period, the application shall be considered as having been denied, and the director shall immediately inform the applicant of such denial.
