Appealing a variance decision to the board of appeals

This section explains how to appeal a decision about a variance. If the director denies your variance application, or if you are hurt by a variance decision, you can appeal to the board of appeals. You must file your appeal within 30 days of the written decision.

(a) If the director denies a variance application, such decision is final except, that, within thirty days after the date of the written decision, the applicant may appeal such action to the board of appeals, pursuant to the rules of practice and procedure of the board of appeals. (b) Any person aggrieved by the decision of the director in the issuance of a variance decision may appeal the director’s action to the board of appeals, in accordance with this chapter, within thirty days after the date of the director’s written decision.
