Yard rules for accessory dwelling units and building as a duplex

This section sets the minimum yard sizes for an accessory dwelling unit. The yard sizes must match the zoning rules for the property, unless the property does not meet zoning standards, then the yard sizes for a property of that size are used. It also allows an accessory dwelling unit and a single-family home to be built as a duplex with a shared wall or floor/ceiling.

(a) The minimum front, rear, and side yard requirements for an accessory dwelling unit shall be the minimum yard requirements for the zoning district in which the building site is situated unless the parcel is nonconforming to the zoning district, in which case the minimum yard requirements of the zoning appropriate to the parcel size shall be required. (b) An accessory dwelling unit and a single-family dwelling unit may be constructed as a duplex (i.e., there is a common wall or floor/ceiling).
