Energy code rules and which buildings are exempt

This section sets minimum energy design and construction rules for most buildings in the county, except for certain federal, agricultural, or non-covered work. It allows flexible, innovative ways to meet energy goals. Some buildings are completely exempt from these rules.

This chapter sets forth minimum requirements for the design and construction of buildings for the effective use of energy and is intended to provide flexibility to allow the use of innovative approaches and techniques to achieve the effective use of energy. It shall apply to all commercial and residential buildings, building sites, and associated systems and equipment within the County inland of the shoreline high-water line. Exceptions to these minimum requirements are listed below: This chapter shall not apply to: (1) Work or installations not covered by the International Energy Conservation Code, 2015 Edition, as adopted and amended by the State Energy Conservation Code, chapter 3-181.1, Hawai‘i Administrative Rules; (2) Work on buildings or premises owned by or under the direct control of the Federal government; or (3) Agricultural buildings, structures, and appurtenances without electrical power and plumbing systems are exempt from permit and construction code requirements, pursuant to section 46-88, Hawai‘i Revised Statutes, except as otherwise provided for in this construction code.
